KVKK Disclosure Notice — Job Applicants

This disclosure notice has been prepared for candidates who apply for a job, under Article 10 of the Personal Data Protection Law no. 6698 (“the Law”) and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Disclosure Obligation. It is separate from the disclosure notice for patients and visitors.

Personal Data Processed

The following data is processed through the job-application form:

• a) Identity and contact data: first name, surname, telephone number, e-mail address.
• b) Professional-experience data: the position applied for, and the education, professional experience and qualification details in your CV.
• c) Data relating to the application process: the application date and the notes you write in the free-text field of the form.

You are not required to share a photograph, association membership, health information or similar data that you may choose to include in your CV. This information is not requested for the assessment of your application. Information not requested: our application form does not ask for gender, marital status, military-service status, health status, habits, association or trade-union membership or similar information. If you share such information of your own accord, it is not taken into account in the assessment of your application.

Purposes of Processing

• Receiving, recording and assessing your application
• Comparing your qualifications with open positions
• Communicating with you during the application process
• Retaining your application for positions that may open in the future — only if you give separate explicit consent for this
• Fulfilling legal obligations and exercising the right of defence in any dispute

Legal Bases

Method of Collection

Your data is collected through the job-application form on our website, in electronic form and by automated means.

Transfers

Your application data is not shared with third parties. A transfer may occur only in the following cases:

• To our IT service providers — solely so that the service can be provided technically, in the capacity of data processor and under a contractual confidentiality obligation
• To authorised public authorities — where there is a request or obligation arising from legislation
• To our legal advisers — in the event of a dispute, limited to the exercise of the right of defence

Reference-contact details are not requested during your application. A reference conversation may only be raised at a later stage, with your knowledge and consent.

Transfers Abroad

Some of the services we use on our website have their servers outside Türkiye. For this reason, the personal data you send through the job-application form is transferred abroad. The transfer is made solely so that the following services can be provided, and is limited to that purpose:

• Notification e-mail — Resend (USA): When you submit your application, the information you enter (full name, telephone, e-mail address, the position applied for and your note) is sent to the clinic by e-mail. This e-mail is sent through the Resend service, which is based in the United States of America.
• The clinic’s e-mail account — Google (USA): The notification e-mail is delivered to, and stored in, the clinic’s e-mail account on Google’s infrastructure.
• Website hosting — Railway (servers in the Netherlands): Our website and the application records, including the CV file you upload, are stored on the Railway service’s servers in the Netherlands (Amsterdam).

Your CV file is not attached to the e-mail; the e-mail contains only a link giving access to this file through the administration panel. Legal basis: These transfers are made on the basis of your explicit consent under Article 9 of the Law. You are not obliged to give explicit consent, and you may withdraw your consent at any time.

Retention Period

• Applications that do not result in recruitment: 1 year from the application date
• Applications for which explicit consent to future retention has been given: 2 years, and immediately if consent is withdrawn
• Applications that result in recruitment: transferred to the personnel file and kept for the periods in the relevant labour legislation

At the end of the period your data is erased, destroyed or anonymised.

Automated Decision-Making

Your application is not analysed by automated systems; recruitment decisions are made through human assessment.

Your Rights

Under Article 11 of the Law you have the right to: learn whether your personal data is processed; request information if it is; learn the purpose of processing and whether the data is used in line with that purpose; know the third parties to whom it is transferred; request rectification if it is incomplete or inaccurate; request erasure or destruction; request that rectification and erasure be notified to the third parties to whom the data was transferred; object to a result against you arising solely from automated analysis; and claim compensation for damage suffered due to unlawful processing. You may submit your requests using the KVKK Data Subject Application Form on our site, or in writing to the address above. Your application is concluded within thirty days at the latest. Explicit Consent Statement — Future Retention of the Application

I give my explicit consent to my job application being retained for the period stated in the disclosure notice, so that it may also be assessed for positions other than the one I applied for that may open in the future. I declare that I understand I am not obliged to give this consent, that if I do not give it my application will still be assessed for the current position, and that I may withdraw my consent at any time, upon which my application will be deleted. The “I consent to my application being retained for the future” box on the job-application form corresponds to this statement and is not mandatory.
